Gun Rights Previal in Heller Decision

WASHINGTON - The Supreme Court ruled Thursday that Americans have a right to own guns for self-defense in their homes, the justices’ first major pronouncement on gun rights in U.S. history.

The court’s 5-4 ruling struck down the District of Columbia’s 32-year-old ban on handguns as incompatible with gun rights under the Second Amendment. The decision went further than even the Bush administration wanted, but probably leaves most firearms restrictions intact.

The court had not conclusively interpreted the Second Amendment since its ratification in 1791. The amendment reads: “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.”

TAMPA - A 21-year-old Clearwater man was arrested at Tampa International Airport this weekend after security personnel found a box cutter in a hollowed-out book, authorities said.box cutter

If convicted, Baines faces up to 10 years in prison and up to a $250,000 fine for a federal charge of attempting to board an airplane with a concealed dangerous weapon. He is currently serving a 30 day sentence after pleading guilty Monday to a state misdemeanor charge of carrying a concealed weapon.

This kid is an idiot. But I would have preferred him be able to board, only to have every other passenger armed with the same or better. Because it would only happen a few times, before these bad guys would learn. Don’t mess around on a airplane. If only the wolves knew that people didn’t mess around, attacks would be more sparse.

I’ve been reading all over the net about peoples experiences with airport security. They bitch and moan about it, but top it off with a “It’s so great that America is doing it’s job keeping me safe”.

1. America may have the responsibility of protection against enemies foreign and domestic, but removing your right to self defense is not one of them.

2. Even with America working to protect you, in the end it is still your sole responsibility to take care of yourself. Not Uncle Sams. Not the POH-leese. You. Take care of your own sorry ass. That means using the tools provided (read weapons).

6 Dead After Gunfire at Missouri Meeting

KIRKWOOD, Mo. (AP) - A gunman with a history of acrimony against civic leaders stormed City Hall during a council meeting Thursday night, killing two police officers and three city officials before law enforcers fatally shot him, authorities said. The mayor was critically injured in the rampage.

The victims at the meeting in suburban St. Louis were killed after the gunman rushed the council chambers and began firing as he yelled “Shoot the mayor!” according to St. Louis County Police spokeswoman Tracy Panus. Two people were wounded before Kirkwood police fatally shot him, she said.

Once again, a bunch of disarmed citizens lose to the armed criminal.

My favorite line of the whole article.

“They’re all just so sad, shocked by this,” said Father Robert Osborne of St. Peter Catholic Church. “This doesn’t happen in Kirkwood.”

This doesn’t happen in Kirkwood. This… does not happen in Kirkwood. Well… I dunno “father”. Looks like it happened to me. When will people pull their heads out of their asses, and understand that this happens anywhere, and everywhere.

Much like Smokey the Bear has his motto… Mine to you is… “Only you can prevent a slaughter”.

Boycott: Antigun Citibank

Citibank has made a statement against your constitutional rights, by refusing to process credit card firearm purchases.

Citi Merchant Services and First Data Corp. are refusing to process any credit card transactions between federally licensed firearms retailers, distributors and manufacturers — a move which will severely limit available inventory of firearms and ammunition to military, law enforcement and law-abiding Americans.

The first company to be affected by this decision appears to be firearms distributor CDNN Sports Inc.

“We were contacted recently by First Data/Citi Merchant Services by a June Rivera-Mantilla stating that we were terminated and funds were being seized for selling firearms in a non-face-to-face transaction,” said Charlie Crawford, president of CDNN Sports Inc. “Although perfectly legal, we were also informed that no transactions would be processed in the future, even for non-firearms. I find this very frightening.”

Supreme Court To Hear DC Gun Ban Case

The Supreme Court announced today that it will decide whether the District of Columbia’s ban on handguns violates the Constitution, a choice that will put the justices at the center of the controversy over the meaning of the Second Amendment for the first time in nearly 70 years.

The court’s decision could have broad implications for gun-control measures locally and across the country, and will raise a hotly contested political issue just in time for the 2008 elections.

The court will hear the case after the first of the year. A decision likely would come before it adjourns at the end of June.

For years, legal scholars, historians and grammarians have debated the meaning of the amendment because of its enigmatic wording and odd punctuation:

Parking Lot Gun Laws and the Right to Transport Firearms

Should people who lawfully possess firearms be able to leave them locked in their motor vehicles, on business property? Common sense would say, “yes.” All 50 states allow the transportation of firearms in motor vehicles for all lawful purposes and 48 states allow the carrying of firearms in vehicles for personal protection, in some manner.1 More than one of every four of America`s 65-80 million gun owners carries a firearm in his or her vehicle for protection.2

The U.S. Constitution and the constitutions of 46 states protect the right to arms and/or self-defense.3 And since 1986, federal law has protected the right to transport firearms in vehicles interstate.4

However, over the last few years disagreements over the right of people to leave firearms locked in their vehicles on business property have arisen. As a result, five state legislatures have passed, and during their current legislative sessions additional states are considering passing, laws to protect that right.5

The issue began in 2002 in Oklahoma, when the Weyerhaeuser corporation fired employees for having guns in personal vehicles on company property. The Oklahoma Legislature responded, unanimously in the House and by a vote of 92-4 in the Senate, by prohibiting “any policy or rule” prohibiting law-abiding people “from transporting and storing firearms in a locked vehicle.”

Apparently, this article and Larry Pratt’s interpretation are misleading. From Snowflakes In Hell:

This bill does not do that. Gun Control Act of 68 is what gave us life time prohibition for mental health commitments and adjudications. HR 2640 actually enables those with mental health problems in their past to clear their names, something they can’t do currently.

The Gun Owners of America is launching an urgent campaign encouraging citizens to call their U.S. senators and ask them to oppose a bill that could be described as “disarmament by diagnosis.”

The legislation would allow a person’s right to own a gun in the U.S. to be permanently removed under a wide range of circumstances.

“You’d think that when rabid, anti-gun legislators like Sen. Charles Schumer and Rep. Carolyn McCarthy join together to pass anti-gun legislation, it would raise a few red flags,” the alert says. “But these two New York Democrats are currently planning to roll over gun owners with H.R. 2640 – legislation which would bar you from owning guns if: You are a battle-scarred veteran suffering from Post Traumatic Stress Disorder; or as a kid, you were diagnosed with ADHD.”

Gun Owners Executive Director Larry Pratt told WND that those are just two of the circumstances that legitimately could be used under the pending proposal to permanently remove an individual’s right to own a weapon in the U.S.

Someone in counseling during a bitter divorce, a child who at one point gets into a scrape on a school yard and is put on Ritalin, or even someone given “counseling” for issues such as depression during recovery from an accident or work-related injury are some other situations that could trigger such “disarmament by diagnosis,” he said.

Zach Doty, Second Ammendment Patriot

Zach is an inspiration for me to open carry. He mentioned on a forum that he’s thinkin of starting a open carry awareness club. I sent him a message, stating I was interested. So hopefully he’ll respond. He’s pretty famous at this point, since all this was happening back in April and May.

POST FALLS, Idaho — Two home-schooled teenagers in this northern Idaho town say they are carrying loaded guns to the library, grocery store and other public areas for self-defense, as a crime deterrent, and to educate others about their rights.

Zach Doty, 18, carries a loaded Glock handgun on his hip. His 15-year-old brother, Steven, carries a .22-caliber rifle in a sling on his back.

Police have been called on several occasions to question the teens but have not found the teens to be in violation of the law.

In Idaho, residents 18 and older can openly carry a firearm in public. And those ages 13 to 17 who have parental permission can carry a rifle in public.

“I certainly don’t anticipate that I’ll need to use it, but I’d rather have it and not need it than to not have it and need it,” Zach told the Coeur d’Alene Press. “There’s no reason for me to hide a weapon.”

Zach was stopped April 17 on his way to Bible study. On Friday, police again responded when someone reported the brothers with guns in a park. But police left after confirming it was the Doty’s. More »

Feel Good Ignorance

So I opened up a flickr account for the Friends of NRA committee that I’m on. I’m planning on using a WP plugin to display the albums on the committee website. I decided to search flickr for any other Friends of NRA photos out there, and immediately stumbled upon this guy’s emotional reaction to the shootings at Virgina Tech. Once I read his whiny rant, I couldn’t help myself. I had to respond.

You’ll have to start off by viewing his “excellent” photo of him crying, and his big long rant of sheer stupidity. Then check the first comment by lakecountry.friends.of.nra (me). I actually respond first to the ridiculous comment above mine.

Well… my response was enough to make him cry all over again, and post a photo just for me! I’m so proud. :razz:


Gun Nuts Are Right?

Time to admit the ‘gun nuts’ are right

In the aftermath of the Petit family slayings in Cheshire, we all reached for explanations: How do human beings sink this low? How could this tragedy have been prevented? Why?

There are so many nagging questions. They all need to be asked. And maybe some old arguments need to be hashed out again.

Why not a more stringent “three strikes and you’re out” law in this state? Connecticut’s version is so weak that it’s more like “30 strikes and we’ll think about it while you strike again.”

Why not speed up the criminal trial process for repeat violent offenders? Get them off the streets. It’s been proposed many times. Most people agree it should be done. It never happens.

Can’t we better monitor the probation process?

Can’t we do a better job of predicting — figuring out which non-violent criminals are about to turn violent?

Are home alarms really effective?

How about dogs?

But somehow all of these ideas pale before the barbarity of this particular crime.

That is why one old question is worth asking again. It is this: What if the Second Amendment is for real? Is it possible that it should it be revered, just like the First Amendment?
